These Terms constitute a legally binding agreement between you and Tangelo Bilişim Ltd., a company registered in Antalya, Turkey ("Tangelo Bilişim," "we," "us," or "our"), the provider of Webcas.tr. Webcas.tr is offered by Tangelo Bilişim Ltd., a Turkish company, and provides a local DNS resolution service designed to enhance DNS resolution reliability, improve internet access, and bypass potential DNS-based restrictions. The Software operates on your device, intercepting DNS queries and resolving them in a secure and efficient manner. As part of its operation, the Software may communicate with a trusted API server located in Germany to facilitate reliable DNS resolution, especially when encountering potentially manipulated or blocked DNS responses. This German API server, in turn, may utilize international public DNS resolvers such as Google Public DNS (8.8.8.8, 8.8.4.4) or Cloudflare (1.1.1.1, 1.0.0.1) to fulfill DNS resolution requests. By using Webcas.tr, you acknowledge and agree to this operational aspect of the Service.
Webcas.tr is intended for personal use to improve internet access and overcome DNS-related issues. It is not a VPN and does not provide general traffic encryption or IP address masking. The primary function is DNS resolution enhancement.
Webcas.tr is strictly a DNS resolution service. It is explicitly NOT a Virtual Private Network (VPN) and does not function as a VPN. It is essential to understand the limitations and intended purpose of Webcas.tr:
By using Webcas.tr, you acknowledge that it is a DNS resolution tool and not a VPN or a means to bypass legal restrictions. Any use of the Software for purposes beyond DNS resolution enhancement, including any unlawful activities, is strictly against these Terms of Service and at your own risk.
Subject to your compliance with these Terms, Tangelo Bilişim Ltd. grants you a limited, non-exclusive, non-transferable, revocable license to use the Software for personal, non-commercial purposes. This license is for your individual use on devices you own or control. All rights not expressly granted to you are reserved by Tangelo Bilişim Ltd.
For commercial use, including but not limited to use within organizations, businesses, or for providing services to third parties, you must obtain a separate commercial license from us. Please contact us through the provided channels for commercial licensing options.

You acknowledge and agree that the Webcas.tr Software, in its operation, may utilize a trusted API server located in Germany for DNS resolution. Furthermore, this German API server, to perform its function effectively, may query international public DNS resolvers such as Google Public DNS (8.8.8.8, 8.8.4.4) and Cloudflare (1.1.1.1, 1.0.0.1). In the free version of Webcas.tr, you do not have the option to customize or prevent the use of these public DNS resolvers by our API server.
While we select reputable public DNS resolvers, their operation and privacy policies are governed by their respective providers. Please refer to their terms and privacy policies for further information. For users with specific requirements regarding DNS resolvers, commercial versions of Webcas.tr may offer customization options; please contact us for details.
The free personal use of Webcas.tr Software is provided as a courtesy and is subject to reasonable usage rate limits. These rate limits are in place to ensure fair usage and maintain the quality of service for all free users. Excessive or abusive usage that exceeds these reasonable limits may result in:

Sections pertaining to Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and General Provisions shall survive any termination of these Terms.
THE SOFTWARE AND WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, TANGELO BİLİŞIM LTD. EXPRESSLY DISCLAIMS ALL WARRANTIES, REPRESENTATIONS, AND CONDITIONS, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, NON-INFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

DOES NOT WARRANT THAT THE SOFTWARE OR WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SOFTWARE OR WEBSITE OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SOFTWARE OR WEBSITE IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TANGELO BİLİŞIM LTD., ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF, OR INABILITY TO USE, THE SOFTWARE OR WEBSITE, OR OTHERWISE RELATING TO THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF TANGELO BİLİŞIM LTD. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF TANGELO BİLİŞIM LTD. ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE SOFTWARE OR WEBSITE EXCEED THE AMOUNT YOU PAID, IF ANY, TO TANGELO BİLİŞIM LTD. FOR THE SOFTWARE OR WEBSITE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED TURKISH LIRA (100 TRY), WHICHEVER IS LOWER. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless Tangelo Bilişim Ltd., its affiliates, officers, directors, employees, consultants, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees and court costs) arising from or relating to (a) your use of the Software or Website, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any rights of another party.
These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Software or Website shall be brought exclusively in the competent courts of Antalya, Turkey, and you irrevocably submit to the jurisdiction of such courts.
Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms, in whole or in part, at any time without notice to you. Any attempted assignment by you without consent shall be void.
Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Tangelo Bilişim Ltd.
Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary such that the remaining provisions of the Terms will continue in full force and effect.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tangelo Bilişim Ltd. relating to the Software and Website and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Tangelo Bilişim Ltd. with respect to the Software and Website.
Headings: The section titles in these Terms are for convenience only and have no legal or contractual effect.
Force Majeure: Neither party shall be liable for any failure to perform its obligations under these Terms if such failure results from circumstances beyond that party’s reasonable control, including, without limitation, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor or materials.
Feedback: Any feedback, comments, ideas, suggestions, or other communications you provide to us regarding the Software or Website ("Feedback") is entirely voluntary. We will be free to use, disclose, reproduce, license, and otherwise distribute and exploit such Feedback as we see fit, entirely without obligation or restriction of any kind on account of intellectual property rights or otherwise.
